This is a call to Property Owners within Ward 3 (stretching from 17th Avenue in Voelklip to Swartdam Road in the west) to subscribe for membership of HPP.

HPP-membership is an inherent right of property owners within the Ward. It has no cost, obligation or liability, and importantly, it gives you ‘a vote’. A right to vote on motions for resolutions of the Board, and in the affairs of HPP.

Simply put: If you don’t subscribe, you do not have a vote! Your vote is now extremely important. Here is the context:

On 5 April 2019 the Overstrand Municipality (OM) delivered ‘a final notice of execution’ for the death of your HPP, the non-profit company, its intellectual capacity, the vital infrastructure and the resources built-up over the past 18 years, or so. Upon shut-down of HPP, what is left of its assets will transfer to the OM! For further information, please refer to the HPP-website (www.hppsecurity.co.za).

The OM-actions rest on good legal advice. It states that in principle the way the OM has debited your rate payments since 2002 ‘lacks legality’ and that this practice must stop on 30 June 2019. The OM provides no practical alternative.

The notice instructs that HPP use its own resources to prolong its death. More importantly, it takes away the security property owners voted for, and paid to have.

In this ‘execution’ of HPP there are valuable post mortem-remains. For example, the modern security infrastructure, networks and cameras will summarily accrue to the OM

The actions of the OM and the notice constitute administrative action, which has triggered the PAJA-Act (Promotion of Administrative Justice Act), particularly in respect of ‘public participation’. In terms of this act, the OM must consider the impact its decision will have on the public. It also must consider alternatives, before any decision is taken. In the absence of public participation, the advice of an alternative SC (Senior Council) is that the actions of the OM are ‘lacking legality.

If you want to have a say in what happens to HPP (and the assets you contributed to) you must become a member. For this purpose, we make available subscription and proxy forms. Please feel free to call if you wish to discuss any question or concern you may have in this regard.

  • Print the membership form that applies to you
  • Complete it by hand (most of the details are available on your monthly municipal account)
